Myerson’s: exploring whether cohabitees have any property rights

If you are unmarried and have split from your partner, it can be confusing to know what rights you have in relation to the property you occupy.

Your rights will differ depending on whether your name is on the legal title and the financial arrangements you had with your partner.

Myerson’s Property Ownership Dispute Team explores what rights you have if your partner owns the house:

My partner owns the house. What rights do I have?

You do not have an automatic right to half of the property because you live there.

If you had a cohabitation agreement drawn up when you moved into the property, then the terms of that agreement should be looked at.

However, if one of the parties no longer wishes to proceed in accordance with the terms of that agreement, you should seek legal advice as soon as possible.

You do not have to be a legal owner of the property to acquire an interest in the property.

There is a possibility that if there was an agreement with your partner that you would have an interest in the property and contribute financially to the property, you may be entitled to a share of the beneficial interest, and you could have a right to the property.

This is known as a constructive trust.

Constructive Trust

A constructive trust arises where it would not be conscionable for the person who owns the legal title to the property to deny the other of an interest in it, as otherwise they would be unjustly enriched.

A constructive trust is based on the parties’ intentions, and it can either be express and therefore written by way of a declaration of trust or inferred through conduct.

It is for you to show that you and the legal owner intended to share the beneficial interest in the property.

Once it has been established that you intended to share the beneficial interest in the property, it may be that your share in the property has increased over time due to a subsequent event or agreement.

Ambulatory Trust

Alternatively, the Court could conclude that there was no initial agreement between you and the legal owner to share a beneficial interest in the property but that this altered over time.

This is referred to as an ambulatory trust. An example of this is when one party may finance an extension or major improvement to the property so that the home is completely different from when it was originally purchased.

If there is a dispute with your partner about the property, you could seek to negotiate a settlement and agree on whether you have an interest in the property, whether the property is to be sold and how any equity in the property is divided.

If you are unable to reach an agreement, you do have the ability to issue court proceedings.

The Trust of Land and Appointment of Trustees Act 1996 (ToLATA) gives the Court certain powers to resolve disputes about ownership of land.

A cohabitee whose name is not on the legal title of the property can make a court application under ToLATA for a declaration that they have an interest in the property, an order that the property be sold and an order as to how the net proceeds of the sale are to be divided.

Disputes between co-owners

Where two or more people own property jointly as joint tenants or tenants in common, they are known as co-owners.

The Court can make an order declaring the extent of a beneficial interest belonging to a co-owner if there is a dispute surrounding this.

If one party does not wish to sell the property, you can make an application to the Court for an order for sale of the property.

If both owners of the property own it as ‘joint tenants’, and you separate, it would be advisable to sever the joint tenancy and therefore own the property as ‘tenants in common’.

This will protect your share of the property should one of you pass away before the property is sold or transferred.

How to avoid property disputes in the future

If you are considering purchasing a property with somebody and are not married, it would be advisable to take advice on how the property will be split.

This could be through a declaration of trust or a cohabitation agreement.

Google Digital Garage confirmed at all-star Female Business Festival

THE FOUNDERS of the Female Business Festival have secured Google Digital Garage as one of their star attractions for this year’s event.

North West-based Janine Friston, Suzi Brown and Hazel Woodward are set to host the festival and accompanying awards night at the Victoria & Albert Hotel in Manchester city centre on Friday, 20 October.

Also confirmed to appear is BBC Dragons’ Den winner and Tiny Box Company founder Rachel Watkyn (pictured), who has built a £10m business with more than 100 staff.

“Rachel’s hugely inspiring story will, I am sure, resonate with female business owners from across the region,” said Janine, who is from Sale.

“During this current cost of living crisis, we felt it was important to invite Google along to teach attendees how to use its free digital tools to grow their businesses.

‘Industry experts in finance, money mindset and marketing will also be taking part in our panel discussions, so that people can take positive, practical steps straight away.”

The festival, now in its second year, coincides with the birthday of the Female Business Network, which Janine founded in October 2021.

Funding boost for Oldham learning and wellbeing business

A social enterprise, which helps local people access much-needed emotional and wellbeing support, is expanding its services thanks to £350,000 funding from the Proper Good programme.

Springhead-based IntraQuest is a specialist learning, wellbeing and community service provider that offers therapeutic support to individuals, families and organisations.

The business was founded by Jen Westwood and Karen Keates from their kitchen table in 2013.

They moved to Earl Mill Business Centre a year later where they started off in a small office before taking over a larger self-contained unit in 2015.

In December 2019, the founders decided to relocate IntraQuest from Earl Mill to their home in Springhead.

IntraQuest successfully applied for two separate rounds of capital investment funding from the Proper Good programme, which supports social entrepreneurs across Oldham, Bolton, Stockport, and Wigan.

The investment allowed Jen and Karen to create a new therapeutic learning and wellbeing space to provide clients with a tranquil and safe space that also connected them to nature.

The founders have also expanded their team of 12 staff with the appointment of a full-time clinical psychologist, Dr Paula Butroid.

Karen said: “With rising overhead costs such as expensive rent, it was time for a rethink about how we wanted to operate. We had the capacity at home to create a unique space for therapy, learning and wellbeing and decided to do just that.

“We aim to help people navigate trauma, release stress and help people move towards living fulfilled lives and what we have created here gives them the space to do that and more.

“We also provide training and professional development at schools and other organisations. This is an area that has continued to grow and we want to expand this service further. There are some exciting projects in the pipeline looking at how we can work with the NHS to expand the work we do.”

Commenting about the funding, Jen said they received the money over two allocations.

“The initial funding allowed us to start the transformation of our outdoor space,” said Jen.

“As a social business, we aim to help people and train other organisations to help people, so we wanted to be able to do that from a space that made people feel welcome and at home.

“We also wanted to reduce the massive overhead costs of working out from rented premises, and this investment allowed us to make those changes.”

The Proper Good programme is a social investment fund ranging between £30,000 and £350,000.

The money is distributed by Greater Manchester Centre for Voluntary Organisation (GMCVO) to help social businesses to grow.

Karen said: “We went to GMCVO because as an organisation, they understand what a social enterprise is, the impact it has on communities and, importantly, they also understand that social businesses can be profitable growing businesses like any other.

“The synergies aligned, and the support we have received has been incredible.”
